The Technical Institute / Al-Door organizes a symposium entitled Custody Provisions in Sharia and Law

Under the patronage of the President of the Northern Technical University and under the supervision of the Dean of the Technical Institute / Al-Door, the Legal Administration Department at the Institute organized a symposium entitled Custody Provisions in Sharia and Law, which was delivered by Mr. Moataz Amer Ahmed, the lecturer in the above department, and attended by a number of the Institute’s employees.

The seminar aimed to:

Introducing custody and its concept in Sharia and law according to the following axes:

  1. Definition of nursery, and the legitimate purpose of it.
  2. Those entitled to custody.
  3. The custodial relative’s right to the custodian, and the means of implementing it.
  4. The rights of the custodian over the custodian, and the right to alimony.
  5. Abuse of the right of custody, and its effect

The seminar revealed several things, the most important of which were:

  1. The spouses, in the event of discord or separation, must agree on the custody of the children, arrange what is related to their housing, expenditure, study, contact and meet with them, and present the interests of the children and raise them in a sound upbringing far from disputes and animosity in quarrels and lust for predation, revenge and scheming.
    1. Those concerned with family affairs in the Islamic world and minority communities must observe the provisions of Sharia and its general purposes in rights, duties and procedures for implementing judgments, choose the most correct from the sayings of scholars, and observe Sharia constants, spatial variables and modern developments.
    1. Expanding the holding of courses and seminars for judges and those interested in social reform; To clarify the provisions of custody, its purposes and procedures in the cases it finds.
    1. Educational institutions, media outlets, preachers, preachers, and imams of mosques contribute to educating the community, men and women, about the legitimate rights and duties of nursery school.
    1. Establishing family counseling centers in which specialists for men and specialists for women are based, who are familiar with Islamic law, regulations, and judicial procedures; To provide advice regarding the rights of the custodian and the custodian, and to introduce the mechanisms of litigation in the courts.
    1. Presenting the recommendations of the nursery symposium to the Council of the Islamic Fiqh Academy.
